The Legal Department acts as the attorney for the City of Wheeling and its officials on a wide range of issues by providing legal advice to the Mayor, City Council and various City Departments.  It also represents the City in court actions involving damage claims against the City and in other actions, including the defense allegations of ordinance unconstitutionality; civil rights actions; suits for collection of taxes; enforcement of such ordinances as the Land Use and Zoning, Building and Traffic codes, damage claims by the City against persons who have damaged City property; eminent domain cases; assessment matters; drafting and reviewing local and state legislation and policies; preparation and review of all City contracts; real estate matters; proceedings before regulatory agencies; actions involving claims concerning Torts, Employment Law, Construction, among others.

The Legal Department values a supportive work environment where dedicated public servants help each other develop the necessary skills to tackle complex legal issues.

Historically, many employees spend their careers at the Legal Department because they value the respect their co-workers have for one another and the high standard of integrity and professionalism that their colleagues exercise in their service to the community.

Under the direction of the City Manager, the City Solicitor:

  • Provides professional legal representation for the City as the chief legal advisor
  • Directs the activities of the Legal Department
  • Provides Legal representation to the City Council in order to assist the Council in conducting affairs in accordance with the statures and laws of the State of West Virginia
  • Conducts investigations and advises on proper actions to take administrative, civil, and criminal cases affecting the City
  • Prepares cases for prosecution in Wheeling Municipal Court, for both criminal case sessions and hearing as well as health, safety, and building code sessions, as well as state and federal court matters.
  • The Assistant City Solicitors report to the City Solicitor
